Terms of service
SECTION 1 – OUR PRODUCTS
We have done our utmost to provide an accurate representation of our products and services in our webshops. Please note, however, that colors or the appearance of the product may differ from what you see on your screen depending on the type of device you use to access the store, as well as your device settings and configuration.
All product descriptions may be changed at any time without notice at our sole discretion. We reserve the right to discontinue the sale of any product at any time and may limit the quantity of products we offer to any person, geographic area, or jurisdiction, on a case-by-case basis.
SECTION 2 – ORDERS
When you place an order, you are submitting a purchase offer. xx reserves the right to accept or reject your order for any reason at its sole discretion. Your order is not accepted until it has been confirmed. Please review your order carefully before submitting it, as xx may not be able to accommodate cancellation requests after an order has been accepted. In the event that we do not accept, modify, or cancel an order, we will attempt to notify you by contacting you at the email address, billing address, and/or phone number provided at the time of ordering. Your purchases may only be returned or exchanged in accordance with our refund policy. You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.
Under Danish consumer law, you as a consumer have a 24-month right of complaint on all goods purchased in our webshop. The right of complaint covers defects and faults that were present at the time of delivery and that are not the result of ordinary wear and tear, improper use, or damage occurring after delivery. If you discover a defect or fault with your item, please contact us as soon as possible and within a reasonable time after the defect has been discovered. You may submit a complaint by contacting us at our email address or phone number, as shown on our contact page. In the case of a valid complaint, we will, after individual assessment, offer repair, replacement, or reimbursement of the purchase price in accordance with the rules of the Danish Sale of Goods Act applicable at any given time.
The right of complaint does not apply to defects, faults, or damage arising from improper use, lack of maintenance, or other circumstances on the part of the buyer. We reserve the right to reject complaints submitted outside the complaint period or that do not meet the above conditions.
SECTION 3 – SHIPPING AND DELIVERY
We offer delivery of your goods through the following freight partners: GLS, DAO, and PostNord. When placing your order, you will have the option to choose your preferred delivery method from the available options. Delivery time and price depend on the chosen freight partner and your delivery address.
We strive to dispatch orders as quickly as possible, but we are not responsible for delays caused by GLS, DAO, or PostNord, including delays due to weather conditions, public holidays, or other circumstances beyond our control. Delivery is made to the address you provided at the time of ordering. It is your responsibility to ensure that the information is correct and complete. We cannot be held liable for missing or delayed delivery resulting from incorrect address information. If a shipment is returned to us as a result, we reserve the right to charge a fee equivalent to the actual return costs. We reserve the right to change freight partners without prior notice if deemed necessary for operational reasons, provided this does not worsen the delivery terms for orders already placed.
SECTION 4 – INTELLECTUAL PROPERTY
Our services, including but not limited to all trademarks, brands, text, screenshots, images, graphics, product reviews, video and audio, as well as the design, selection, and arrangement thereof, are owned by Ita Est, its affiliates, or licensors and are protected by US and foreign patent, copyright, and other intellectual property laws.
These terms grant you the right to use the services solely for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the services without our prior written consent. Unless expressly stated otherwise herein, nothing in these terms grants or shall be construed as granting you a license or any other rights under any patent, trademark, copyright, or other intellectual property belonging to Ita Est or any third party. Unauthorized use of the services may constitute a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Ita Est.
Ita Est's names, logos, product and service names, designs, and slogans are trademarks of Ita Est or its affiliates or licensors. You may not use such trademarks without prior written permission from Ita Est. All other names, logos, product and service names, designs, and slogans on the services are trademarks of their respective owners.
SECTION 5 – RELATIONSHIP WITH SHOPIFY
Ita Est is powered by Shopify, which enables us to provide the services to you. However, all purchases and sales you make in our store take place directly with Ita Est. By using the services, you acknowledge and agree that Shopify is not responsible for any aspects of sales between you and Ita Est, including damages, harm, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or in connection with your purchases and transactions with Ita Est.
SECTION 6 – PAYMENT
We offer the following payment methods in our webshop: Visa, Dankort, Mastercard, Apple Pay, and MobilePay.
Payment is charged to your payment card or via the chosen payment service at the time of order confirmation. We reserve the right to verify payment information before processing the order, and we may reject payments that cannot be authorized by the relevant payment provider.
We do not collect or store your card details. All payment transactions are processed in accordance with applicable security standards, including PCI DSS, and your payment information is handled solely by the respective payment providers, including Visa, Mastercard, Apple Pay, and MobilePay. We are not responsible for errors, rejections, or delays caused by these third-party systems.
All prices in the webshop are stated inclusive of VAT unless otherwise expressly indicated. We reserve the right to change prices without prior notice, provided that the price applicable at the time of your order is binding for that transaction.
SECTION 7 – PRIVACY POLICY
All personal data we collect through the services is subject to our privacy policy, which can be viewed here, and certain personal data may be subject to Shopify's privacy policy, which can be viewed here.
By using the services, you acknowledge that you have read these privacy policies.
As the services are hosted by Shopify, Shopify collects and processes personal data about your access to and use of the services in order to provide and improve the services for you. Information you submit to the services will be transferred to and shared with Shopify and third parties, which may be located in countries other than the country in which you reside, for the purpose of providing services to you. We are not and will not be obligated to (1) treat your feedback as confidential, (2) pay compensation for your feedback, or (3) respond to your feedback.
We may, but are not obligated to, monitor, edit, or remove feedback that we, at our sole discretion, determine to be unlawful, offensive, threatening, defamatory, libelous, pornographic, obscene, or otherwise objectionable or in violation of any party's intellectual property or these terms of service.
You agree that your feedback will not infringe any third party's rights, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You further agree that your feedback will not contain defamatory or otherwise unlawful, offensive, or obscene content, or contain computer viruses or other malware that could in any way affect the operation of the services or related websites. You may not use a false email address, impersonate another person, or otherwise mislead us or third parties as to the origin of feedback. You are solely responsible for all feedback you provide and its accuracy. We assume no obligation and accept no responsibility for feedback submitted by you or third parties.
